LocalVerify provides a powerful email verification tool designed with privacy as its core principle. Our unique value proposition is our "local processing" architecture. Unlike cloud-based services, our desktop applications process your data directly on your machine. Your data, including email lists, never leaves your computer and is never uploaded to our servers when using our desktop applications. The Service may be offered through various plans, including but not limited to our Windows application, our native macOS application, and our enterprise-grade API for programmatic access.
2. Acceptance of Terms
By purchasing a license, downloading our software, or using our Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization or entity ("Organization"), then you are agreeing to these Terms on behalf of that Organization, and you represent and warrant that you have the authority to bind the Organization to these Terms.
3. User Accounts and Licenses
To access and use the Service, you must purchase a license or subscribe to a plan. You agree to provide accurate, complete, and current information during the registration and purchase process. You are responsible for safeguarding your license key and any account credentials. You are solely responsible for all activities that occur under your account.
4. Payments, Subscriptions, and Refunds
4.1. Billing
We offer various subscription plans, including monthly and annual billing cycles. By choosing a subscription plan, you authorize us and our third-party payment processors (e.g., Cashfree) to charge your payment method on a recurring basis for the subscription fees, plus any applicable taxes.
4.2. Renewals
To ensure uninterrupted service, your subscription will automatically renew at the end of each billing cycle unless you cancel it. You may cancel your subscription at any time through your account settings or by contacting our support team.
4.3. Refunds
Refund policies are determined by the plan you purchase. Generally, fees are non-refundable except as required by law or as explicitly stated in our refund policy at the time of purchase. We encourage users to utilize our free trial, where available, to evaluate the Service before purchasing.
5. User Responsibilities and Conduct
You agree to use the Service in compliance with all applicable laws and regulations. You are solely responsible for the data you process through our Service. You agree not to:
- Use the Service for any illegal purpose, including but not limited to sending unsolicited commercial email (spam).
- Attempt to reverse engineer, decompile, or otherwise discover the source code of our software.
- Share, resell, or sublicense your license key or access to the Service.
- Use the Service in a manner that could damage, disable, overburden, or impair our servers or networks (primarily applicable to API usage).
6. Intellectual Property
The Service, including the LocalVerify name, logo, software, and all related intellectual property, are and will remain the exclusive property of LocalVerify and its licensors. Your use of the Service grants you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms, but does not grant you any ownership rights.
7. Privacy and Data
Your privacy is our priority. As stated in Section 1, our desktop applications are designed to process your data locally on your device. We do not have access to, nor do we store, the email lists you verify through these applications. For users of our API service, data is processed to provide the service, but is handled according to our separate Privacy Policy, which you should also review.
8. Disclaimer of Warranties and Limitation of Liability
The Service is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. While we strive for high accuracy, we do not guarantee that the verification results will be 100% accurate or that the Service will be uninterrupted, secure, or free from errors.
You acknowledge that using email verification tools may involve risks, such as IP address rate-limiting or blocking by email providers. We are not responsible for any such issues arising from your use of the Service.
To the maximum extent permitted by law, LocalVerify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
10. Changes to Terms
We may modify these Terms from time to time. If we make material changes, we will provide you with notice, such as by sending an email or displaying a notice within the Service. Your continued use of the Service after the effective date of the new Terms constitutes your acceptance of the changes.
